These Terms of Use (“Terms”) are a legal agreement between you and GAMISTAN (PRIVATE) LIMITED (“Gamistan,” “we,” “us,” or “our”) and govern your access to and use of our mobile games, applications, websites, and related services that link to these Terms, including any updates, features, content, virtual items, advertisements, and in-app services offered through them collectively, the “Services”.
By downloading, installing, accessing, purchasing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not access, download, purchase, install, or use the Services.
1. License and Restrictions
Subject to these Terms, Gamistan grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial entertainment purposes only.
You may not:
a) modify, translate, reverse-engineer, reverse-compile, decompile, disassemble, or create derivative works based on the Services;
b) copy, reproduce, duplicate, sell, resell, distribute, sublicense, or otherwise exploit the Services without our prior written permission;
c) use any data mining, scraping, extraction, bots, crawlers, scripts, or automated tools to access or collect information from the Services;
d) use the Services for any illegal, harmful, fraudulent, abusive, or unauthorized purpose;
e) interfere with, disrupt, hack, damage, overload, or impair the Services or servers connected to the Services;
f) bypass, disable, remove, or interfere with any security, access control, anti-cheat, age-control, or copy-protection features;
g) use cheats, exploits, automation software, hacks, bots, mods, or unauthorized third-party software designed to modify or affect gameplay;
h) infringe the intellectual property, privacy, publicity, or other rights of Gamistan or any third party;
i) use Gamistan’s name, logos, trademarks, branding, or content without our prior written approval.
Where the Services include a downloadable mobile game or application (“App”), this license allows you to use the App only on authorized devices for personal and non-commercial use. The App may not be copied, rented, sold, sublicensed, or transferred.
These Terms apply to all versions, updates, upgrades, free versions, paid versions, and any additional features of the Services.
2. Age Requirements and Parental Consent
Our Services are intended for a general audience.
If you are under the age required by applicable law to consent to these Terms or to the processing of personal data, you may use the Services only with permission from a parent or legal guardian.
By using the Services, you confirm that:
a) you are legally permitted to use the Services in your country; or
b) your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
If applicable laws require parental consent for the collection or processing of personal information, we will either seek legally valid parental consent or provide a version of the Service that does not collect, use, or disclose personal information except as permitted by applicable law.

3. Access to the Services and Accounts
Some Services may allow or require you to create an account or connect through a third-party platform, such as an app store, game service, or social network.
You agree that:
a) all information you provide must be accurate, complete, and up to date;
b) your account is personal to you and may not be sold, rented, transferred, gifted, or shared;
c) you are responsible for maintaining the confidentiality of your login credentials;
d) you are responsible for all activity that occurs through your account;
e) we may suspend or terminate your account or access to the Services if you violate these Terms or applicable law.
You are responsible for any internet, mobile data, device, carrier, or other charges that may apply when accessing or using the Services.
4. App Stores and Platform Terms
If you download, install, access, or purchase the Services through Apple App Store, Google Play, Amazon Appstore, or any other app store or distribution platform, your use of the Services may also be subject to the terms, conditions, and policies of that platform.
In case of any purchase, subscription, refund, download, update, or platform-related matter, the relevant app store or platform terms may apply.
Gamistan is not responsible for any payment processing, billing, refund decisions, download restrictions, device compatibility issues, or account actions handled by third-party app stores or platforms.
5. Third-Party Services, Products, Advertisements, and Links
The Services may include or display third-party services, advertisements, rewarded ads, interstitial ads, banner ads, analytics tools, software development kits, payment processors, app store services, external links, or third-party offers.
Advertisements may be provided by third-party advertising networks, mediation platforms, or partners.
Your interaction with any advertisement, third-party offer, external website, product, or service is solely between you and the relevant third party.
Gamistan does not control third-party websites, platforms, services, advertisements, offers, or products. We are not responsible for their content, policies, availability, accuracy, security, claims, or practices.
Your use of third-party services may be governed by separate terms and privacy policies of those third parties. You are responsible for reviewing and complying with those terms.
6. In-App Purchases, Virtual Currency, and Virtual Items
Our Services may include the ability to earn, unlock, purchase, receive, or otherwise obtain in-game currency, coins, gems, rewards, boosters, hints, skins, bundles, subscriptions, or other digital items (collectively, “Virtual Items”).
Virtual Items are licensed to you for use only within the applicable Service. They are not real money, do not have monetary value, and cannot be exchanged, transferred, sold, redeemed, or converted into cash, goods, services, or value outside the Services.
You acknowledge and agree that:
a) you do not own Virtual Items;
b) Virtual Items are provided under a limited, revocable, non-transferable, non-sublicensable license;
c) Gamistan may manage, regulate, modify, remove, limit, or discontinue Virtual Items at its discretion;
d) Virtual Items may be lost, forfeited, or removed if your account is suspended, terminated, deleted, inactive, or if the relevant Service is discontinued;
e) Gamistan is not responsible for loss of Virtual Items due to technical issues, device problems, unauthorized access, platform issues, or violation of these Terms.
All purchases are processed by the relevant app store or payment platform, such as Google Play or Apple App Store. You should review the payment terms, refund policies, and subscription rules of the relevant app store before making a purchase.
Purchases, subscriptions, virtual currency, and virtual items are processed by the applicable app store or payment provider. Refunds are handled according to the policies of the relevant app store or payment provider, unless otherwise required by applicable law.
7. Subscriptions
Some Services may offer paid subscription memberships (“Subscriptions”).
When you purchase a Subscription, you agree that:
a) the Subscription fee will be charged through the app store or payment method shown at the time of purchase;
b) the Subscription may automatically renew unless cancelled before the renewal date;
c) renewal charges may be applied for the same subscription period unless cancelled;
d) you are responsible for managing and cancelling your Subscription through your app store account settings.
To stop automatic renewal, you must cancel your Subscription before the renewal deadline required by the relevant app store.
For Google Play subscriptions, cancellation is managed through Google Play account settings. For Apple App Store subscriptions, cancellation is managed through Apple ID subscription settings.
If a Subscription includes daily rewards or benefits, you may need to open the relevant game or Service to claim those rewards. Rewards may not be granted for days when you do not access the Service.
8. User Content and Online Conduct
Some Services may allow you to create, upload, submit, post, share, display, or transmit content, including names, messages, images, gameplay content, comments, screenshots, videos, feedback, or other materials (“User Content”).
You are solely responsible for your User Content and your conduct while using the Services.
You agree not to submit, post, upload, transmit, or share User Content that:
a) violates any law, regulation, or third-party right;
b) is abusive, threatening, harassing, defamatory, hateful, obscene, pornographic, violent, misleading, fraudulent, or offensive;
c) infringes intellectual property, privacy, publicity, or contractual rights;
d) contains viruses, malware, spyware, corrupted files, or harmful code;
e) includes personal information of another person without consent;
f) promotes cheating, hacking, phishing, exploits, scams, fake currency, or unauthorized software;
g) contains unauthorized advertising, spam, solicitation, or promotional material;
h) impersonates another person or falsely represents your identity.
Gamistan may monitor, review, remove, restrict, disable, or delete User Content at its discretion, but we are not obligated to do so.
By submitting User Content through the Services, you confirm that you have all necessary rights and permissions to submit such content. You grant Gamistan a worldwide, royalty-free, fully paid, non-exclusive, transferable, sublicensable license to use, reproduce, modify, adapt, publish, display, perform, distribute, promote, and create derivative works from that User Content in connection with operating, improving, marketing, and promoting the Services.
9. Intellectual Property Rights
All rights, title, ownership, and intellectual property rights in and to the Services, including games, software, gameplay systems, artwork, designs, characters, animations, sounds, music, logos, names, graphics, interfaces, code, features, content, and related materials, are owned by Gamistan or its licensors.
The Services are protected by copyright, trademark, and other intellectual property laws.
You may not use, copy, modify, distribute, transmit, reproduce, create derivative works from, publicly display, publicly perform, or commercially exploit any part of the Services without prior written permission from Gamistan.
You may create screenshots or gameplay videos for personal, non-commercial sharing, streaming, or commentary, provided that such use does not violate these Terms, applicable laws, platform policies, or our rights.
10. Updates, Changes, and Availability
Gamistan may update, modify, suspend, discontinue, remove, or restrict access to any part of the Services at any time without prior notice.
We may also introduce new features, remove old features, change gameplay mechanics, adjust rewards, modify virtual items, fix bugs, or update technical requirements.
We do not guarantee that the Services will always be available, uninterrupted, secure, error-free, or compatible with all devices or operating systems.
11. Disclaimer of Warranties
The Services are provided on an “as is” and “as available” basis.
To the maximum extent permitted by applicable law, Gamistan makes no warranties, representations, or guarantees of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, accuracy, security, or error-free performance.
We do not guarantee that:
a) the Services will meet your expectations;
b) the Services will be uninterrupted, secure, or error-free;
c) defects or bugs will be corrected;
d) the Services will be free from viruses or harmful components;
e) the Services will function properly with all devices, systems, networks, or third-party software.
Your use of the Services is at your own risk.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Gamistan, its directors, shareholders, officers, employees, contractors, affiliates, licensors, partners, and service providers will not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to your use of, or inability to use, the Services.
This includes, without limitation, damages for loss of data, loss of progress, loss of virtual items, loss of profits, loss of goodwill, device issues, service interruptions, unauthorized access, third-party conduct, or any other loss related to the Services.
Some jurisdictions do not allow certain limitations or exclusions of liability. In such cases, some of the above limitations may not apply to you.
13. Indemnification
You agree to defend, indemnify, and hold harmless Gamistan, its directors, shareholders, officers, employees, contractors, affiliates, licensors, partners, and service providers from and against any claims, losses, damages, liabilities, costs, and expenses, including legal fees, arising out of or related to:
a) your use or misuse of the Services;
b) your violation of these Terms;
c) your User Content;
d) your violation of any law or regulation;
e) your violation of any third-party rights;
f) your unauthorized use of Virtual Items, accounts, software, or third-party tools.
Gamistan reserves the right, at its own expense, to assume exclusive defense and control of any matter subject to indemnification by you.
14. Termination
These Terms remain effective until terminated by either you or Gamistan.
You may stop using the Services at any time.
Gamistan may suspend, restrict, or terminate your access to the Services or your account at any time, with or without notice, if:
a) you violate these Terms;
b) you violate applicable law;
c) your conduct may harm Gamistan, other users, third parties, or the Services;
d) we discontinue the Services;
e) we believe termination is necessary for security, legal, operational, or business reasons.
Upon termination, your license to use the Services will immediately end, and you must stop using the Services.
Any provisions that by their nature should survive termination will continue to apply, including intellectual property rights, disclaimers, limitation of liability, indemnification, dispute resolution, and payment-related obligations.
15. No Assignment
You may not assign, transfer, sublicense, or delegate your rights or obligations under these Terms without prior written consent from Gamistan.
Gamistan may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, restructuring, sale of assets, or business transfer.
16. Governing Law and Dispute Resolution
These Terms shall be governed by and interpreted in accordance with the laws of Pakistan, unless mandatory consumer protection laws in your country of residence provide otherwise.
Any dispute, claim, or controversy arising out of or relating to these Terms, the Services, your use of the Services, Virtual Items, User Content, or your relationship with Gamistan shall first be attempted to be resolved amicably by contacting us.
If the dispute cannot be resolved amicably, it may be submitted to the competent courts or dispute resolution forum having jurisdiction under applicable law.
Nothing in these Terms limits any rights you may have under mandatory consumer protection laws.
17. Changes to These Terms
Gamistan may update or modify these Terms from time to time.
When we make changes, we may update the “Last Updated” date above. Continued use of the Services after the updated Terms become effective means you accept the revised Terms.
If you do not agree to the updated Terms, you must stop using the Services.

19. Entire Agreement
These Terms, together with our Privacy Policy and any additional terms that apply to specific Services, constitute the entire agreement between you and Gamistan regarding the use of the Services.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
Failure by Gamistan to enforce any provision of these Terms shall not be considered a waiver of our rights.
